Challenging a Criminal Conviction With Help From a Walnut Creek Criminal Appeal Attorney

If you or your loved one has been convicted of a DUI, gun charges, or any other crime in Walnut Creek, a criminal appeal can provide a critical opportunity to challenge the outcome of the case.

Criminal appeals offer a path to review potential legal errors made during the original trial, including improper evidence handling, judicial missteps, or procedural issues that may have impacted the fairness of the verdict. This post-conviction process is essential for anyone seeking to ensure that justice was fully served in their case.

However, the appeals process is notoriously complex, requiring an intricate understanding of appellate procedures and strict timelines. Unlike a trial, an appeal relies heavily on written arguments, or briefs, that highlight legal flaws in the initial proceedings rather than re-examining factual evidence. To navigate this challenging process effectively, having an experienced attorney with in-depth knowledge of the appellate court system is crucial.

At Geller Law, PC, I help clients navigate the criminal appeals process and fight for a fair review of their cases. With my extensive criminal defense and appellate court experience, you can trust me to provide the skilled representation you need to handle the complexities of the appellate court system and steer your case toward the best possible outcome.

What Is a Criminal Appeal?

A criminal appeal is a legal process in which a defendant seeks to have a higher court review the decisions made in their original trial. It is not a retrial, meaning no new evidence or witnesses are introduced, and the facts of the case are not reconsidered. Instead, an appeal asks the appellate court to examine whether the trial was conducted fairly and according to the law.

During the appeal process, the appellate court reviews the trial court’s actions to determine if any legal errors occurred that could have influenced the outcome. This may include errors in admitting evidence, incorrect jury instructions, or mistakes in applying the law. The appellate court’s role is to ensure that these potential errors did not undermine the defendant’s right to a fair trial. If significant legal mistakes are found that may have affected the verdict, the appellate court can reverse the conviction, alter the sentence, or, in some cases, order a new trial.

Grounds for Filing a Criminal Appeal

There are two primary grounds (or reasons) for filing a criminal appeal in California: insufficient evidence and mistakes of law before or during the trial.

Insufficient Evidence

This ground argues that the evidence presented at trial was not enough to support a conviction. California courts require that a conviction must be based on “proof beyond a reasonable doubt.” In cases where the prosecution’s evidence does not meet this legal standard of proof the appellate court might review the evidence and potentially overturn the conviction if they find it was indeed insufficient.

Mistakes of Law (Legal Errors)

A mistake of law occurs when the judge misinterprets or misapplies the law during the trial. Mistakes of law can include incorrect jury instructions, improper admission or exclusion of evidence, or procedural errors.

For instance, if a judge allows a confession that was obtained in violation of the defendant’s Miranda rights (e.g., without reading the defendant their rights), the defense may argue on appeal that this error contributed to an unfair conviction.

Another example would be if the judge gave the jury instructions that misrepresented the legal standards for proving an element of the crime, potentially leading to an incorrect guilty verdict. An appellate court may reverse a conviction if it finds that this error likely influenced the outcome.

Other possible grounds for appeal include:

  •  Ineffective Assistance of Counsel: Defendants have a constitutional right to effective legal representation. If their attorney’s performance was below a reasonable standard, this can be grounds for an appeal. If, for instance, a defense lawyer didn’t investigate an alibi that could have proven the defendant’s innocence, this could qualify as ineffective assistance.
  • The invalidity of a Guilty Plea: If a conviction was the result of a plea agreement that required the defendant to plead guilty, a defendant might appeal on the grounds that their plea wasn’t made voluntarily, knowingly, or intelligently.  For example, if a defendant was not fully informed of the consequences of their plea or felt pressured to accept it, the plea may be considered invalid.

Each of these grounds requires strong evidence to demonstrate that the original trial was flawed. In such cases, the appellate court reviews the original trial record and determines whether any legal or factual errors affected the outcome of the trial and whether or not the conviction was justified.

The Importance of Timely Filing

In California, filing a criminal appeal comes with strict deadlines, making it critical for defendants to act quickly. The timelines vary slightly based on the court and type of conviction, but generally, they’re very short.

For a felony conviction, you have 60 days from the date of judgment or sentencing to file a notice of appeal. For a misdemeanor, the deadline is even shorter—typically just 30 days. Missing these deadlines can be catastrophic, as the right to appeal is generally lost once these time limits pass. In other words, if you fail to file on time, you likely forfeit your opportunity to challenge the conviction altogether.

This is why consulting an experienced appeals lawyer promptly is so crucial. An appeals attorney can help you understand the deadlines, evaluate the grounds for appeal, and start building a strong case. They can ensure that all required documents are filed accurately and on time, preserving your right to appeal.

Appeals are complex, and the process can be unforgiving. Starting quickly with a knowledgeable lawyer not only protects your rights but also maximizes your chances of success.

I make it a priority to file the notice of appeal promptly to secure their right to appeal, and I maintain a strict schedule to guarantee that every required document is prepared and submitted on time.

I also conduct an in-depth review of potential grounds for appeal by carefully examining trial records, witness testimonies, and legal rulings while looking for issues like insufficient evidence, legal errors, ineffective assistance of counsel, or problems with a plea agreement. This thorough assessment helps me identify the most compelling grounds for appeal, allowing me to build a strong, focused argument for my clients.

With my full attention on each case and a commitment to detailed analysis and timely filing, I work diligently to give my clients the best possible chance of a successful appeal.

Possible Outcomes of a Criminal Appeal

When you file a criminal appeal, several potential outcomes are possible. If the appeal is successful, the case against the defendant may be dismissed or sent back to the trial court for a retrial or further proceedings, depending on the specifics of the appellate court’s decision. Another possible outcome is a modification of the sentence, where the appeals court reduces the penalties without overturning the conviction itself.

The appeals court may also affirm the conviction and deny the appeal, meaning they find no grounds for change. However, if the appeal is denied, this does not necessarily mean the fight is over. At Geller Law, PC, I can help you assess whether appealing to a higher court, such as the California Supreme Court or even the U.S. Supreme Court, is a viable option. This level of appeal is rare and selective, still, I am prepared to pursue every available avenue to advocate for justice in your case.

Each step of the appeals process is complex and demanding, but I am committed to guiding my clients through it and exploring every option to protect their rights.
