WHAT IS A DRUG OFFENSE?

If you are caught in possession, cultivating or manufacturing, or trafficking drugs, in San Francisco you will be charged with a crime. With the exception of marijuana less than one ounce, you will be placed in jail and must post bond or wait until your court appearance to get out of jail if you are found to be violating drug laws of the state of California.

Some of the most common types of drug related offenses individuals in California are charged with include:

  • Simple Possession
  • Possession with Intent to Sell
  • Manufacturing Methamphetamine
  • Drug Trafficking
  • Possession of Drug Paraphernalia (including pipes, bongs, syringes)

If you are convicted of a drug related crime you may face up to 11 months, 29 days in jail if you are charged with a misdemeanor, and 1 year to life in prison if charged with a felony. There are additional penalties that come with a drug related conviction in addition to jail time, including fines, drug classes, probation and/or parole, and more.
